October 7, 2020:

The Fremont County Board of Supervisors met in regular session on October 7, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that IT Arnold Emberton and Sandy Parmenter with Valley News Today were present by telephone.  

Supervisor Graham discussed his I-29 Corridor Project Meeting. The group discussed what they envision for the future. They are looking at setting up public input meetings. They asked the members what things they love about their county, what would make living here better, and what they envision fifty years in the future. They are reviewing the comprehensive plan from 2006 and the housing study from 2017. They will continue with these meetings. The board will continue with flood updates each week.   

Engineer Dan Davis did not meet with the board regarding the signings of the title sheets as there was an issue with the paperwork. 

Motion made by Sheldon to approve the renewal of the Class C/Sunday Sales Beer Permit for The Junction (Cubby’s). Motion carried unanimously. 

Motion by Sheldon to approve the following new hire for the sheriff’s office. Motion carried unanimously.

RESOLUTION NO. 2020-47

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 7th day of October, 2020, that the following individual shall be approved as a Deputy for the Fremont County Sheriff’s Department, as requested by Fremont County Sheriff Kevin Aistrope. The effective date of employment shall be September 28th, 2020:

Motion by Graham to allow Chairman Hickey to sign asbestos agreement with Terracon for buyout inspections. Motion carried unanimously. 

Motion made by Graham to allow Chairman Hickey to sign the GAX Form to draw from the CDBG Grant for the East and West Nishnabotna Watershed Project. Motion carried unanimously. 

In other business, the Recorder’s Monthly Report for September was approved. 

Claims were approved for October 9, 2020

October 14, 2020:

The Fremont County Board of Supervisors met in regular session on October 14, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that IT Arnold Emberton was present by telephone. Assistant County Attorney Tyler Loontjer, Assistant Engineer Robbie Kromminga, and Veronica Barreto-Rosa with the Hamburg Reporter attended in person. 

Supervisor Graham updated the board on the IEDA I-29 Corridor Project. Public meetings are being planned and hope to be finalized tomorrow. Tentatively there are two meetings being planned. One meeting will be for the Pacific Junction/Highway 34 area and will be held on October 28th at 6:00 p.m. with the location to be determined. The other will be the Hamburg/Highway 2 area and will be on October 29th at 6:00 p.m. with the location to be determined. Graham stated they will hopefully confirm those locations at a meeting tomorrow. The board will continue with flood updates each week.   

Assistant Engineer Robbie Kromminga Dan Davis met with the board regarding the following:

Motion by Sheldon to allow Chairman Hickey to sign two title sheets for Project ER-CO36(85) - - 58-36 (on J-24 from L-31 2.431 miles to West of Thurman),  and Project FM-CO36(89) - - 55-36 (on J-10 over BNSF RR from L-31 0.112 miles). Motion carried unanimously. 

The board discussed two applications for residents to withdraw from the buyout program. Motion by Graham to allow Chairman Hickey to sign the buyout withdraw forms for Burge and Ware. Motion carried unanimously. 

Supervisor Sheldon briefly discussed a property that is on the buyout list that has been fixed up and is being lived in near Percival. The board will reach out to Alexsis Fleener with SWIPCO regarding this matter. 

The board discussed rescinding Resolution No. 2020-40 regarding requesting reimbursement from the Iowa COVID-19 Government Relief Fund. The reason for rescinding is a change in the dollar amount and dates.

Motion by Graham to approve Resolution No. 2020-48 rescinding Resolution No. 2020-40 requesting reimbursement from the Iowa COVID-19 Government Relief Fund. Motion carried unanimously.

A resolution by Fremont County to request reimbursement for eligible costs related to the COVID-19 public health emergency from the Iowa COVID-19 Government Relief Fund.

WHEREAS, the United States Congress approved the Coronavirus Aid, Relief, and Economic Security (CARES) Act to provide economic relief related to the COVID-19 pandemic.

WHEREAS, Governor Kim Reynolds allocated $125 million of the State of Iowa's CARES Act funding to local governments for direct expenses incurred in response to the COVID-19 emergency.

WHEREAS, local government funding reimbursements may only be used for necessary expenditures incurred due to the COVID-19 pandemic, were not accounted for in the current fiscal year county budget, were incurred during the time period of March 1, 2020 through July 31, 2020 and have not been reimbursed from other sources.

NOW, THEREFORE BE IT RESOLVED, Fremont County requests reimbursement of $14,427.40 in eligible expenditures in response to the COVID-19 public health emergency.

BE IT FURTHER RESOLVED, Fremont County affirms that the above requests for reimbursement follow all formal published Federal and State of Iowa guidance on how the funds should be spent, and understand if the reimbursements are misrepresented, the local government will be liable for any applicable penalty and interest.

HEREBY RESOLVED by the Board of Supervisors for Fremont County on this 2nd day of September, 2020.

Motion by Graham per request from the City of Tabor to appoint Colleen Crom as a non-resident member to fill one of two vacancies on the Tabor Library Board of Trustees. Motion carried unanimously.

October 21, 2020:

The Fremont County Board of Supervisors met in regular session on October 21, 2020, in the Fremont County Courthouse Boardroom, with Hickey and Sheldon present. Graham present by telephone. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that IT Arnold Emberton, Dean Doty, Carol Doty, Sandy Parmenter with Valley News Today, and Veronica Barreto-Rosa with the Hamburg Reporter were present by telephone. Engineer Dan Davis, Assistant Engineer Robbie Kromminga, and Barb Beran attended in person. 

Sheldon stated that the haul road by Percival will not be worked on for at least a couple of weeks. The board will continue with flood updates each week. 

Engineer Dan Davis met with the board regarding the following:

Motion by Sheldon to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for emergency repair construction on J-64 per agreement through 09/30/20, Project # ER-CO36(82) - - 58-36. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for engineering services for engineering/surveying services for J-64 per agreement through 09/30/20 (flood damage). Motion carried unanimously. 

Motion by Graham to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for engineering services for J-10 design per agreement through 09/30/20. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for engineering/surveying services for J-34 & L-31 per agreement through 09/30/20 (flood damage). Motion carried unanimously. 

Motion by Graham to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for engineering services for J-24 Emergency Repairs from NB I-29 On/Off Ramps to West Corporate Limits of Thurman per agreement through 09/30/20. Motion carried unanimously. 

Barb Beran met with the board to discuss County Road J-64. She stated that the condition of J-64 east of Hamburg is terrible. She has also asked to have the lines painted the past several years. She said the drop-offs in some of the areas are very dangerous. Engineer Davis stated that they let the project to paint the lines on September 16th and then the contractor had four people that had to quarantine, so they have not been working. He stated the stripes will be painted this year, but the resurfacing will be later in the future. With flooding, the projects have been pushed back. Beran reiterated the need for the work to be done.   

The board considered the financial assurance for closure/post closure costs letter. This is a yearly letter that the board signs for the landfill. Motion was made by Sheldon to allow Chairman Hickey to sign the letter. Motion carried unanimously. 

Dean & Carol Doty called in to see if the board had any updates on notices regarding the abandoned properties in Bartlett. The board didn’t have any updates. Doty’s stated they would reach out to one landowner’s family to see if they could help. 

The board discussed an agreement between Fremont County and Barry & Cindy Whitehill Trust regarding the Iowa Watershed Approach Project. Morgan stated that the board received partial payment for their project. She gave the board details of the project. There will be a pond, grass waterways, and prairie strips among other features. Motion by Sheldon to sign the agreement. Motion carried unanimously. Morgan discussed more upcoming funding and project opportunities. 

Motion made by Sheldon to approve the 2020/2021 Fremont County budget amendment for publication with a public hearing date of  November 11, 2020, at 9:30 a.m. Motion carried unanimously.

October 28, 2020:

The Fremont County Board of Supervisors met in regular session on October 28, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that IT Arnold Emberton, Sandy Parmenter with Valley News Today, and Veronica Barreto-Rosa with the Hamburg Reporter were present by telephone. Engineer Dan Davis attended in person. 

Graham stated that the IEDA public meetings for the I-29 corridor project start today. The meetings for Pacific Junction are today at 3:00 p.m. and 6:00 p.m. The meetings for Hamburg are at the Colonial Theatre tomorrow at 3:00 p.m. and 6:00 p.m. The engineer of the project is facilitating these meetings. There will be limited space for attendance due to Covid-19 restrictions. They did their best to get the word out about these meetings. Graham is looking at the whole county for development. He hopes that all the citizens of the county will come out and voice their opinions.  There will be more meetings in the future. Hickey stated that they got the north part of the Scott Drainage District Ditch completed. The board will continue with flood updates each week. 

The board discussed a flood recovery project presented by Supervisor Graham. This is the Knox Road infrastructure project (Safe Route to School). This would be for water, sanitary sewer, and storm sewer. This was put on the back burner at the last flood recovery fund meeting as they did not consider it a priority. There were FRF recently returned to the fund when projects were completed under budget. The hope is that there will be funds available now through the FRF for this project. Motion by Sheldon to allow Chairman Hickey to sign the application for the funds. Motion carried unanimously. 

Engineer Dan Davis met with the board regarding the following:

Motion by Sheldon to allow Chairman Hickey to sign work in ROW permit for Tom Lorimor to clear trees along 182 Street west of L-68. Motion carried unanimously. 

Motion by Graham to allow Chairman Hickey to sign 2021 County 5-Year Program Resolution 0.3 for modification of Project ER-CO36(81) - - 58-36 (J34-220th Street). Motion carried unanimously. 

Motion by Sheldon to allow Chairman Hickey to sign work in ROW permit for underground construction by Rock Port Telephone Co. to place fiber optic line from L-72 north to County Road 310th Street, then east on 310th Street for 1 mile to 360th Ave, then south on 260th Avenue to 322nd Street. Motion carried unanimously. 

Motion by Graham to sign resolution to accept low bid and award construction contract to A.M. Cohron & Son, Inc. on project #BROSCHBP-CO73(123) - - GB-73 (bridge replacement). Motion carried unanimously.

RESOLUTION NO. 2020-50

RESOLUTION TO ACCEPT LOW BID AND AWARD CONSTRUCTION CONTRACT

WHEREAS, the Fremont County Secondary Roads Department and the Page County Secondary Roads Department held a joint letting for construction projects on October 20, 2020, and

WHEREAS, two (2) bids were received for BROSCHBP-CO73(123) - - GB-73 for Bridge Replacement – PPCB,

NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Fremont County that the contract be awarded to A.M. Cohron & Son, Inc. for the low bid of $1,974,343.59, if which $1,245,346.14 is the responsibility of Fremont County. The cost of this project shall be paid from Federal Funds.

Motion to approve made by Graham.

Motion by Graham to allow Chairman Hickey to sign IDOT payment voucher with HGM Associates for engineering services for L-31 over Waubonsie Creek per agreement through October 15, 2020. Motion carried unanimously. 

The board discussed the request for proposal for demolition for the buyout program. The board expressed concern regarding a situation like the county has with the debris removal. They do not want a contractor preparing a blind bid and running into the same problem. There is not a set number of houses. People can back out of the buyout program at the day of signing. They are also concerned about the start dates with the contractor. At 9:35 a.m., the board called Alexsis Fleener and Sandy Hansen with SWIPCO. They clarified that these will be on a per house basis so there are stipulations in the RFP that protect the county even if the homeowner backs out of the program. Motion by Sheldon to approve the RFP for the demolition of the homes in the buyout program. Motion carried unanimously.
