August 2020

August 5, 2020:

The Fremont County Board of Supervisors met in regular session on August 5, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was unanimously approved as posted. 

Let the records show that IT Arnold Emberton and Sandy Parmenter with Valley News Today were present by telephone. Engineer Dan Davis, Assistant Engineer Robbie Kromminga & EMC Mike Crecelius and Ryan Finke with Leick Construction attended in person. 

There were no updates regarding rehabilitation assistance and non-structural alternatives to rehabilitation of flood control projects. The board will continue with flood updates each week.  EMC Crecelius notified the board of the Iowa COVID-19 Local Government Relief Fund and will further discuss details at a future meeting. 

Engineer Dan Davis met with the board for the following:

Motion by Sheldon to allow Chairman Hickey to sign application for underground construction in right-of-way for MidAmerican Energy to install three-phase electric cable along west side of 300th Avenue & north side of Highway 2 to serve the Sidney Water Treatment Plant. Motion carried unanimously. 

Engineer Davis opened sealed bids for FEMA Projects for Sites 20, 46, & 48.  Three bids were presented as follows:

1.)
      Leick Construction, Inc. $379,394.50
2.)
      Reilly Construction $863,093.50
3.)
      CJ Moyna & Sons, LLC $630,476.50

Davis will review the bids and present a resolution to accept a bid at the August 12, 2020, meeting. 

Motion by Graham to allow Chairman Hickey to sign cover sheet for Project No. L-CO36 (260th Street Bridge Repair) - - 73-36 260th Street: Bridge Rehabilitation. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Hickey to sign resolution to add additional project to 2021 County Five-Year Program, L-CO36 (2021 Pavement Markings) - - 73-36. Motion carried unanimously. 

Motion by Graham to have all three board members sign Title Sheet for Project L-CO36(2021 pavement markings) - - 73-36. Motion carried unanimously. 

The board discussed the State of Iowa Contingent Loan. Auditor Owen checked with the state regarding the Flood Recovery Funds. There are not enough funds allocated at this time to cover the project costs. The terms of the State of Iowa Contingent Loan is 0% interest for 10 years.  Motion by Graham to proceed with the application process to borrow $195,000 for debris removal expenses incurred from the 2019 Flood.  Motion carried unanimously.  

The board discussed a vacancy on the zoning commission. Motion by Graham to appoint Rod McGinley to the Fremont County Zoning Commission. Motion carried unanimously. 

Motion made by Graham to allow Chairman Hickey to sign the GAX Form to draw from the CDBG Grant for the East and West Nishnabotna Watershed Project. Motion carried unanimously. 

Claims were approved for August 7, 2020

In other business, the Recorder’s Monthly Report for July was approved. 

At 9:28 a.m., there being no further business, Graham made a motion to adjourn. Motion carried unanimously.

August 12, 2020:

The Fremont County Board of Supervisors met in regular session on August 12, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:02 a.m. Minutes of the previous board session were read and approved. The agenda was unanimously approved as posted. 

Let the records show that IT Arnold Emberton and Sandy Parmenter with Valley News Today were present by telephone. Assistant County Attorney Tyler Loontjer, Assistant Engineer Robbie Kromminga & EMC Mike Crecelius attended in person. 

Supervisor Graham stated he will be attending a meeting tomorrow at 11:00 a.m. regarding an EDA Grant regarding land use along the I-29 corridor. He will bring back the information to the board about what was discussed. The board will continue with flood updates each week. 

Assistant Engineer Robbie Kromminga met with the board regarding the following:

Motion by Sheldon to approve Resolution No. 2020-34 to accept the low bid from Leick Construction, Inc. for FEMA projects for sites 20, 46, and 48 in the amount $379,394.50. Motion carried unanimously.

RESOLUTION NO. 2020-34

Award of Bid for Project L-CO36(FEMA 262ndStreet) - - 73-36

262nd Street: On 262nd Street, Under I-29, from West of I-29 E .38 miles to East of I-29 S34 T68 R43 –

The project is compromised of 3 divisions, each division has the same type of work. They type of work is the rebuilding of roadways from the floods in March of 2019. This involves rebuilding the road bed, reshaping of the ditches, and applying new surface material within the confines of the project.

BE IT RESOLVED, by the Fremont County Board of Supervisors, as follows:

Section 1: That bid for L-CO36(FEMA 262nd Street) - - 73-36 be awarded to the low bidder, Leick Construction, Glenwood, IA for the total cost of $379,394.50.

Section 2: That the chair be authorized to sign the contract documents on behalf of the board.

Section 3: That this resolution shall take effect immediately.

Motion by Graham to allow Chairman Hickey to sign application for underground construction in right-of-way for MidAmerican Energy to rebuild existing lines from Lincoln Street in Farragut to 2151 370th Avenue. Motion carried unanimously. 

The board discussed the State of Iowa Contingent Loan. The board discussed appealing FEMA’s funding of the debris removal contract. The bill for debris removal is $195,000. FEMA is estimating the costs to be $19,963.48. The board would like to see an itemized statement from the contractor to present to FEMA for our appeal. Sheldon stated that we owe it to the taxpayers to try to appeal the amount. Motion by Sheldon to move forward with the State of Iowa Contingency Loan with the amount to be determined after the appeal and information gathering regarding the asphalt pad. Motion carried unanimously. 

In other business, the Sheriff’s Monthly Report for July was approved.  

Claims were approved for August 14, 2020

August 19, 2020:

The Fremont County Board of Supervisors met in regular session on August 19, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:01 a.m. Minutes of the previous board session were read and approved. The agenda was unanimously approved as posted. 

Let the records show that IT Arnold Emberton, Gabe Klooster with Invenergy, Mike Blazer with Invenergy, Isaac Lampaa with Invenergy and Sandy Parmenter with Valley News Today were present by telephone. Assistant County Attorney Tyler Loontjer, Engineer Dan Davis, Cara Morgan with RC & D, Jake Miriovsky with JEO Consulting Group & EMC Mike Crecelius attended in person.

Engineer Dan Davis met with the board regarding the following:

Motion by Graham to allow Chairman Hickey to sign application for Approval of 2 Meteorological (MET) Towers with John E. & Cheryl A. Whipple for Whipple Family Trust and Gruber Farms, Inc.   Motion carried unanimously.

Motion by Graham to allow Chairman Hickey to sign IDOT Payment Voucher in the amount of $95.02 for Professional Engineering Services on J10.  Motion carried unanimously.

Motion by Sheldon to allow Chairman Hickey to sign IDOT Payment Voucher in the amount of $3,257.48 for Professional Engineering/Surveying Services on J64.  Motion carried unanimously.

Motion by Sheldon to allow Chairman Hickey to sign IDOT Payment Voucher in the amount of $1,425.23 for Professional Engineering Services on J24.  Motion carried unanimously.

Motion by Graham to allow Chairman Hickey to sign IDOT Payment Voucher in the amount of $3,770.07 for Emergency Repair Construction Services on J64.  Motion carried unanimously.

Motion by Sheldon to allow Chairman Hickey to sign IDOT Payment Voucher in the amount of $29,422.48 for Engineering Services for L31 over Waubonsie Creek.  Motion carried unanimously.

Motion by Graham to allow Chairman Hickey to sign Railroad Agreement from BNSF for J10 Crossing.  Motion carried unanimously.

Motion by Graham to allow Chairman Hickey to sign Railroad Agreement from BNSF for J24 Crossing.  Motion carried unanimously.

Motion by Sheldon to allow Chairman Hickey to sign IDOT Pay Voucher in the amount of $11,967.34 for Flood Repair Design Services on J34 and L31.  Motion carried unanimously. 

Motion by Graham to approve the following tax abatement resolution for the Sidney Community School. Motion carried unanimously.

RESOLUTION NO. 2020-35

RESOLUTION ABATING TAXES ON LAND OWNED BY SIDNEY COMMUNITY SCHOOL DISTRICT

WHEREAS, the Sidney Community School District now owns certain property in Sidney, Fremont County, Iowa, Parcel No. 470470487000000, described as: LOT 8 OF 8 EXC E 172.7' W 246.55' OF S 150' & EXC S 66' & LOT 9 NW SE and Parcel No. 470470491000000, described as: LOTS 6 & 7 & LOT 4 OF LOT 8 NW SE EXC S 109 FT OF LOT 7 & LOT 4 OF  LOT 8 , City of Sidney, Fremont County, Iowa, according to the recorded plat thereof.

WHEREAS, the property is now owned by the Sidney Community School District and therefore should not be on the tax rolls according to Section 427.1(2), Code of Iowa,

IT IS HEREBY RESOLVED that the above described property shall be listed as exempt on the tax list of the Fremont County Auditor.  Further, all current and delinquent real property taxes are abated under Iowa Code Section 445.63.

BE IT FURTHER resolved that the Auditor and Treasurer shall enter such change orders required to abate these taxes.

Motion by Sheldon not to move forward with the 403 Demolition Program.  Motion carried unanimously.               

Motion by Graham to request SWIPCO to publish RFP for Historic Context Report of homes qualifying for the buyout program.  Motion carried unanimously. 

Motion by Graham to approve the following stamped warrant resolution. Motion carried unanimously.

RESOLUTION # 2020-36

RESOLUTION TO TEMPORARILY CEASE PURCHASE OF AND INVESTMENT IN STAMPED WARRANTS

WHEREAS, pursuant to Chapter 331 of the Iowa Code allows the counties to purchase stamped warrants from other governmental entities to hold as an investment; and,

WHEREAS, Fremont County, through its Board of Supervisors, has participated in such purchase of and investment in stamped warrants when it is in the best interest of the County; and

WHEREAS, the Board of Supervisors has determined it is in the best interest of Fremont County, in light of the financial burdens caused by the 2019 Flood and COVID-19 pandemic, to temporarily cease purchase of and participation in such investments until further resolution of the Board of Supervisors.

NOW, THEREFORE, BE IT RESOLVED by the Fremont County Board of Supervisors that Fremont County hereby temporarily ceases pursuing the purchase of or investment in any and all non-mandatory stamped warrants until it is determined, by resolution of this Board, to again be in the best financial interest of Fremont County and its residents.

No action was taken on buyout property splits after discussion with Assistant County Attorney Loontjer because appraisals on the properties by parcel have been completed.

Motion by Graham to request SWIPCO to publish Asbestos Inspection RFP for buyout properties.  Motion carried unanimously. 

Jake Miriovsky with JEO and Cara Morgan with Golden Hills RC & D met with the board regarding the approval of task order for the East/West Nishnabotna Watershed Project.  Motion by Hickey to allow Chairman Hickey to sign task order 2.7.2 for Phase One Archaeological Study with the Fremont County cost being $33,382.50.  Motion carried unanimously.  

Claims were approved for August 21, 2020

August 26, 2020:

The Fremont County Board of Supervisors met in regular session on August 26, 2020, in the Fremont County Courthouse Boardroom, with Hickey, Sheldon, and Graham present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was unanimously approved as posted. 

Let the records show that IT Arnold Emberton, Court Administrator Bob Gast, and Sandy Parmenter with Valley News Today were present by telephone. Engineer Dan Davis, Assistant Engineer Robbie Kromminga, Clerk of Court Robin Shirley, & Karen Garner attended in person. 

The board discussed the Scott Drainage District Project briefly. Engineer Davis updated the board on an upcoming call with Michelle Terry with Iowa Homeland Security & Emergency Management. The board will continue with flood updates each week. 

Engineer Davis opened sealed bids for the following projects:

1.)      L-CO36 (260TH Street Bridge Repair) - - 73-36. They received one bid from Cunningham Reis, LLC in the amount of $313,736.50. 

2.)      L-CO36 (2021 Pavement Markings) - - 73-36. They received one bid from Iowa Plains Signing, Inc. in the amount of $131,771.95.

Davis will review the bids and present a resolution to accept the bids if approved at the September 2, 2020, meeting. 

The board discussed the nuisance abatement property at 3829 170th Street. The resident was given and extension to clean up the property and was to give the board an update on the progress. Karen Garner stated that she is waiting on a third bid to come in to put up a shed on her property. Assistant Engineer Kromminga told her how to go about getting a building permit. Garner stated they have been moving things off the property. Kromminga stated that he went to look at the property and not much progress has been made. Garner stated she is planning to put the vehicles in the shed once it is built. Sheldon stated she needs to show the board progress. He said he would consider a short extension and she would need to present proof that they are moving ahead with putting up a building like a building permit and something from a contractor. Motion by Hickey to extend the deadline to September 30th and Garner would need to provide the afore mention paperwork. Motion carried unanimously. 

4th District Court Administrator Bob Gast and Clerk of Court Robin Shirley met with the board to discuss alternate juror space. They are trying to keep the exposure levels down in the courthouse. They think they can accommodate the jury trial in the courthouse but would like to be able to hold the jury selection in an alternate building. Gast stated that the state will not enter into a contract with an outside site. It would be the county’s responsibility for the contract. He was thinking the site would need to be able to socially distance 40 people. The board discussed various locations. Auditor Owen stated they are already having issues with polling places. Shirley had spoken to the Waterfalls Event Center in Farragut. There are no other buildings in the county that would house those numbers. Sheldon stated that he would recommend the venue in Farragut. Gast said he will have a site survey before the board goes ahead with the contract. He thought that would be around two weeks.

Dharmista Bhaskar Patel did not phone in to discuss the property taxes due on Parcel No. 430430486000000 in Hamburg. 

Motion made by Sheldon to approve the Class C Beer, Class B Native Wine, and Sunday Sales Liquor License for Sidney Foods. Motion carried unanimously. 

Motion by Sheldon to approve resolution to appoint part-time employee at the sheriff’s office.  Motion carried unanimously.

RESOLUTION NO. 2020-37

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 26th day of August 2020, that the following individual shall be approved as a Dispatcher/Jailer for the Fremont County Sheriff’s Department, as requested by Fremont County Sheriff Kevin Aistrope. The effective date of employment shall be August 12th, 2020.
