August 4, 2016: 

KENDRICK SENTENCED TO FIVE YEARS IN PRISON FOR METHAMPHETAMINE-RELATED CRIMES

SIDNEY, IOWA –Jackie Douglas Kendrick, age 64, New Market, Iowa, was sentenced on Monday, August 1 in Fremont County District Court to five years in prison for Gatherings Where Methamphetamine Unlawfully Possessed or Distributed, a Class D Felony, and a probation violation on a previous conviction of Possession of Methamphetamine, Third or Subsequent Offense, a Class D Felony. Kendrick was charged and convicted pursuant to a traffic stop in Shenandoah in June 2016. 

On June 12, 2016, a Fremont County Sheriff’s Deputy conducted a routine traffic stop in Shenandoah, Iowa on Highway 59. The vehicle was occupied by three persons, including Jackie Kendrick. During this traffic stop, Jackie Kendrick was found to be in possession of several individually packaged baggies of methamphetamine. Kendrick was placed under arrest and has been held in the Fremont County Jail since that date.  Kendrick is currently awaiting transportation to the Iowa Medical and Classification Center at Oakdale where he will begin serving his five-year prison sentence.  

This case was investigated by the Fremont County Sheriff’s Office. Fremont County Attorney Corey Becker prosecuted the case.

OMAHA MAN SENTENCED TO FIVE YEARS IN PRISON FOR VEHICLE THEFT

SIDNEY, IOWA –Jeffrey James Ivey, age 23, Omaha, Nebraska, was sentenced on Monday, July 18 in Fremont County District Court to five years in prison for Theft in the Second Degree, a Class D Felony. Ivey was charged and convicted pursuant to an Iowa State Patrol investigation in June 2016.  

On June 4, 2016, an Iowa State Patrol officer received a report of a stolen vehicle leaving Omaha, Nebraska southbound on Interstate 29. State radio advised the officer that the stolen vehicle was seen at a house in Fremont County near Percival, Iowa. Upon arrival in Percival, the patrol officer made contact with the car and ordered the driver, later identified as Jeffrey James Ivey, to exit the vehicle. Upon this command, Ivey attempted to elude the officer by driving through a field southbound towards 200th Street and made his way on to Interstate 29. The driver was eventually stopped on the southbound exit ramp of Exit 10 off Interstate 29 but not before the chase reached speeds of over 100 MPH. Ivey is currently awaiting transport to the Iowa Medical and Classification Center at Oakdale where he will begin serving his five-year prison sentence. 

This case was investigated by the Iowa State Patrol, with the cooperation of the Fremont County Sheriff’s Office. Fremont County Attorney Corey Becker prosecuted the case.

OMAHA MAN SENTENCED TO TEN YEARS IN PRISON FOR POSSESSION WITH INTENT TO DISTRIBUTE METHAMPHETAMINE

SIDNEY, IOWA –Rex Lee Kmiecik, age 35, Omaha, Nebraska, was sentenced on Tuesday, July 5 in Fremont County District Court to ten years in prison for Possession with Intent to Distribute Methamphetamine, a Class C Felony. Kmiecik will not be eligible for parole until he serves a minimum of one-third of his ten year sentence under Iowa’s mandatory minimum sentencing law for methamphetamine distributors. Kmiecik was charged and convicted pursuant to a Fremont County Sheriff’s Office narcotics investigation in April 2016. 

On April 27, 2016, the Fremont County Sheriff’s Office Narcotics Unit conducted a narcotics investigation in which Rex Lee Kmiecik arranged to purchase more than two pounds of methamphetamine from a confidential informant for approximately $13,000. Kmiecik arranged to meet undercover law enforcement in the northern part of Fremont County near Interstate 29. Upon arrival in Fremont County, Kmiecik exchanged currency for more than two pounds of real and simulated methamphetamine. The investigation revealed that Kmiecik believed he could sell the methamphetamine in 48 hours. After the exchange, Kmiecik was taken into custody and was transported to the Fremont County Jail for booking. Kmiecik is currently awaiting transport to the Iowa Medical and Classification Center at Oakdale where he will begin serving his ten-year prison sentence.

Shawn Lee Haynie, age 44, Shenandoah, Iowa, appeared with his attorney and entered a plea of guilty to Criminal Mischief in the Third Degree, an Aggravated Misdemeanor. Judgement and sentence were deferred for a period of one year. Haynie was placed on formal probation for one year and ordered to pay a civil penalty of $625. Haynie was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable. 

Blake Ryan Kennell, age 24, Hamburg, Iowa, appeared with his attorney and entered a plea of guilty to Domestic Abuse Assault, a Serious Misdemeanor. Kennell was sentenced to 60 days in the Fremont County Jail with credit for any time served. Kennell was also ordered to pay court costs, surcharges, and court appointed attorney fees, if applicable. 

Nikki Lynn Garner, age 40, Shenandoah, Iowa, appeared with her attorney and entered a plea of guilty to Possession of Prescription Drug or Device without a Prescription, a Serious Misdemeanor. Judgement and sentence were deferred for a period of one year. Garner was placed on informal probation for one year and ordered to pay a civil penalty of $315. Garner was also ordered to pay court costs, surcharges, and court appointed attorney fees, if applicable.

Jeffrey James Ivey, age 23, Omaha, Nebraska, appeared by his attorney and entered a plea of not guilty to Theft in the Second Degree, a Class D Felony, and Eluding While Participating in a Felony, a Class D Felony. Pretrial conference is set for July 18, 2016 at 1:30 pm and trial is set for August 30, 2016 at 9:30 am in the Fremont County Courthouse.

Dustin William Rutledge, age 18, Sidney, Iowa, appeared by his attorney and entered a plea of not guilty to Driving While License Denied or Revoked Under Chapter 321J, a Serious Misdemeanor. Pretrial conference is set for July 18, 2016 at 1:30 pm and trial is set for August 30, 2016 at 9:30 am in the Fremont County Courthouse.

COUNCIL BLUFFS MAN SENTENCED TO TEN YEARS IN PRISON FOR METHAMPHETAMINE CRIMES

SIDNEY, IOWA – Brandon Eugene Gutheil, age 30, Council Bluffs, Iowa, was sentenced on Monday, June 6 in Fremont County District Court to ten years in prison for methamphetamine-related crimes. Pursuant to a plea agreement between County Attorney Corey Becker and the defendant, Gutheil plead guilty to Gatherings Where Methamphetamine is Unlawfully Delivered, a Class D Felony, and Failure to Affix a Drug Tax Stamp, a Class D Felony. The sentence associated with both charges will be served consecutively totaling ten years in prison. Gutheil was charged and convicted pursuant to a Fremont County Sheriff’s Office narcotics investigation in April 2016.  

On April 1, 2016, the Fremont County Sheriff’s Office Narcotics Unit conducted a narcotics investigation near Bartlett, Iowa. During this investigation, Brandon Gutheil and a female co-defendant were observed arriving in a small sedan near the Bartlett exit off Interstate 29. Gutheil was observed exchanging one ounce of methamphetamine for approximately $1,000 in marked US currency to a confidential informant. After the controlled exchange was made, the sedan containing Gutheil and the female co-defendant was stopped and both were taken into custody. Pursuant to information obtained after the stop, approximately 19 grams of additional methamphetamine was recovered from a hotel room in Council Bluffs, Iowa. Gutheil is currently awaiting transport to the Iowa Medical and Classification Center at Oakdale where he will begin serving his ten year prison sentence.

May 25, 2016:

BRADDYVILLE MAN SENTENCED TO TEN YEARS IN PRISON FOR POSSESSION WITH INTENT TO DELIVER METHAMPHETAMINE

SIDNEY, IOWA – Jerry Dewayne Easley, age 45, Braddyville, Iowa, was sentenced on Monday, May 9 in Fremont County District Court to ten years in prison for Possession with Intent to Deliver Methamphetamine, a Class C Felony. Easley was charged and convicted pursuant to a traffic stop on Interstate 29 by the Fremont County Sheriff’s Office. Easley will not be eligible for parole until he has served at least one-third of his sentence under Iowa’s mandatory minimum sentencing law for methamphetamine distributors.  

On March 19, 2016, the Fremont County Sheriff’s Office executed a traffic stop at approximately the 14.5 mile marker on Interstate 29. In the vehicle were Easley, a female co-defendant, and two children. Easley and the female co-defendant were both found to lack a valid driver’s license. While conducting a routine tow inventory of the vehicle, law enforcement found a box containing approximately 66 grams of crystal methamphetamine along with several items of drug dealer paraphernalia. Also found in the vehicle was approximately $2,500 in cash. Easley and the female co-defendant were arrested and charged with methamphetamine related crimes. Easley is currently in custody at the Iowa Medical and Classification Center at Oakdale to begin serving his ten year prison sentence.

May 16, 2016

Thomas Lee Knipe, age 36, Tabor, Iowa, appeared with his attorney and entered a plea of guilty to Possession with Intent to Distribute Methamphetamine, a Class C Felony; Failure to Affix a Drug Tax Stamp, a Class D Felony; and Introducing a Controlled Substance into a Detention Facility, a Class D Felony. Knipe was sentenced to 20 years in prison. Knipe was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable.

Easley was sentenced to 10 years in prison. Easley was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable. 

Montana Wayne Kroupa, age 30, Essex, Iowa, appeared with his attorney and entered a plea of guilty to Distribution of Marijuana, a Class D Felony. The sentence was suspended and Kroupa was placed on formal probation for a period of two years. Kroupa was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable. 

Michael Monroe Welch, age 22, Sidney, Iowa, appeared with his attorney and entered a plea of guilty to Theft in the Third Degree, an Aggravated Misdemeanor. Judgement and sentence were deferred for a period of one year. Welch was placed on formal probation for one year and ordered to pay a civil penalty of $625. Welch was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable. 

James Thomas Hume, age 27, Sidney, Iowa, appeared with his attorney and entered a plea of guilty to Carrying Weapons, an Aggravated Misdemeanor. Judgement and sentence were deferred for a period of two years. Hume was placed on formal probation for two years and ordered to pay a civil penalty of $625. Hume was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable.

Roger Craig Kissel, age 68, Sidney, Iowa, came before the Court for sentencing after being convicted by a jury of his peers of Sexual Abuse in the Second Degree, a Class B Felony, and two counts of Lascivious Acts with a Child, a Class C Felony, on March 4, 2016. Kissel was sentenced to 25 years in prison. Kissel was also ordered to pay restitution, court costs, and surcharges. The Honorable Judge Susan Christensen presided over both trial and sentencing.  

Mark Anthony McCammon, age 26, Knoxville, Tennessee, appeared with his attorney and entered a plea of guilty to Possession of Marijuana with Intent to Deliver, a Class D Felony. Judgement and sentence were deferred for a period of two years. McCammon was placed on formal probation for a period of two years and ordered to complete the terms of probation. McCammon was also ordered to pay a $750 civil penalty along with all court costs and surcharges. 

Jason Lee Myers, age 27, Clarinda, Iowa, appeared by his attorney and entered a plea of guilty to Theft in the Fourth Degree, a Serious Misdemeanor. Myers was sentenced to 30 days in the Fremont County Jail. Myers was placed on formal probation for a period of one year and ordered to complete the terms of probation. Myers was also ordered to pay restitution, court costs, surcharges, and court appointed attorney fees, if applicable.

Carl Benson Ward, age 43, Riverton, Iowa, appeared by his attorney and entered a plea of not guilty to two counts of Assault on Persons Engaged in Certain Occupations, an Aggravated Misdemeanor; one count of Interference with Official Acts, an Aggravated Misdemeanor; and one count of Operating While Intoxicated, a Serious Misdemeanor. Pretrial conference is set for June 6, 2016 at 1:30 pm and trial is set for July 12, 2016 at 9:30 am in the Fremont County Courthouse.

Vohs was found to be in willful contempt of court and sentenced to 14 days in the Fremont County Jail. Vohs was also ordered to pay all court costs and court appointed attorney fees, if applicable.

Kendrick was sentenced to a term of five years in custody, all suspended. Kendrick was placed on formal probation for two years. Kendrick was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Trenton Levi Jordan, age 20, Riverton, Iowa, appeared with his attorney and entered a plea of guilty to Possession of Methamphetamine with Intent to Deliver, a Class C Felony. Judgement and sentence were deferred for a period of two years. Jordan was placed on formal probation for a period of two years and ordered to complete the terms of probation. Jordan was also ordered to pay a $1,000 civil penalty along with all court costs, surcharges, and court appointed attorney fees, if applicable. 

Adam Scott Matson, age 31, Sidney, Iowa, appeared with his attorney and entered a plea of guilty to Assault on Persons Engaged in Certain Occupations, an Aggravated Misdemeanor. Judgement and sentence were deferred for a period of one year. Matson was placed on formal probation for one year and ordered to pay a $625 civil penalty. Matson was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable.  

David Wayne Miller, 45, Hamburg, Iowa, appeared with his attorney and admitted to violating the terms and conditions of his probation. Miller was found to be in willful contempt of court and sentenced to 30 days in the Fremont County Jail. Miller was also ordered to pay all court costs and court appointed attorney fees, if applicable.

April 14, 2016: 

SIDNEY MAN SENTENCED TO FIVE YEARS IN PRISON FOR METHAMPHETAMINE AND FORGERY CRIMES

Clinton Gabriel Cook, age 35, Sidney, Iowa, was sentenced on Monday, April 11 in Fremont County District Court to five years in prison for Forgery, a Class D Felony, and Gatherings Where Methamphetamine Unlawfully Used or Distributed, a Class D Felony. Cook had previously entered a plea of guilty to the charges in March of this year. 

On November 11, 2015, the Fremont County Sheriff’s Office Narcotics Unit conducted a narcotics investigation in Hamburg, Iowa. During the investigation, Clinton Cook and another co-defendant, were found to be involved in the distribution of methamphetamine. Cook was arrested on the methamphetamine charge in early January 2016. Prior to taking Cook into custody, the Fremont County Sheriff’s Office began investigating Cook for an unrelated case involving the forgery of several checks used at Casey’s General Store in Sidney, Iowa. Once in custody, Cook was charged pursuant to the forgery investigation. Cook is currently awaiting transportation to the Iowa Medical and Classification Center at Oakdale to serve his five year sentence.

Larry James White, age 49, Farragut, Iowa, appeared with his attorney and entered a plea of guilty to Child Endangerment, an Aggravated Misdemeanor. White was sentenced to 120 days in the Fremont County Jail. White was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Daniel Scott Dean, age 36, Knoxville, Tennessee, appeared with his attorney and entered a plea of guilty to Possession of Marijuana with Intent to Deliver, a Class D Felony. At open sentencing, judgement and sentence were deferred for a period of two years. Dean was placed on formal probation for a period of two years. Dean was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Allen Kent Iverson, age 60, Sidney, Iowa, appeared by his attorney and entered a plea of guilty to Possession of Marijuana - First Offense, a Serious Misdemeanor. Judgement and sentence were deferred for a period of one year. Iverson was placed on informal probation for one year and ordered to pay a $350 civil penalty. Iverson was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable.

Jason Andrew Schebaum, age 42, Shenandoah, Iowa, appeared by his attorney and entered a plea of not guilty to Count One – Operating While Intoxicated, a Serious Misdemeanor. Pretrial conference is set for April 25, 2016 at 1:30 pm and trial is set for June 7, 2016 at 9:30 am in the Fremont County Courthouse.

Stacey Dawn Budenholzer, age 32, Omaha, Nebraska, appeared with her attorney and entered a plea of guilty to Conspiracy to Deliver Methamphetamine, a Class C Felony. Budenholzer was sentenced to 10 years in prison. Budenholzer was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable.  

Timothy Allen McCollum, age 40, Bartlett, Iowa, appeared with his attorney and entered a plea of guilty to Intimidation with a Dangerous Weapon, a Class C Felony. McCollum was sentenced to 10 years in prison. McCollum was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Jacob Nicholas Thorne, age 20, Sidney, Iowa, appeared with his attorney and entered a plea of guilty to Delivery of Marijuana, a class D Felony, and Tax Stamp Violation, a Class D Felony. Thorne was sentenced to 10 years in prison. Thorne was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Victor Bruce Ingrim, age 42, Shenandoah, Iowa, appeared with his attorney for sentencing after entering a plea of guilty to Delivery of Methamphetamine, a Class C Felony. Ingrim was sentenced to 10 years in prison. Ingrim was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. The Mills County Attorney’s Office served as special prosecutor in this case.

Jason Tyler Michael Vance, age 21, Hamburg, Iowa, appeared by his attorney and entered a plea of guilty to Possession of Methamphetamine with Intent to Deliver, a Class C Felony. Sentencing is set for April 18, 2016 at 1:30 pm in the Fremont County Courthouse. 

Jason Lee Sarabia, age 18, Shenandoah, Iowa, appeared with his attorney and entered a plea of guilty to Theft in the Second Degree, a Class D Felony. SIDNEY MAN SENTENCED TO PRISON FOR SALE OF 17 POUNDS OF MARIJUANA IN FREMONT COUNTY

SIDNEY, IOWA – Jacob Nicholas Thorne, age 20, Sidney, Iowa, was sentenced on Monday, March 14 in Fremont County District Court to ten years in prison for Delivery of Marijuana and Tax Stamp Violation, both Class D Felonies. Thorne was charged and convicted pursuant to an undercover drug investigation in Bartlett, Iowa.  

On February 24, 2016, the Fremont County Sheriff’s Office Narcotics Unit, with the assistance of the Cass and Montgomery County Sheriff’s Office, conducted an undercover drug investigation in Bartlett, Iowa. While conducting this investigation, Thorne and an accomplice were observed exchanging more than 17 pounds of marijuana for $18,000 in cash. After the exchange had been made, both suspects were intercepted and arrested without incident. Both the marijuana and cash were recovered by law enforcement. Thorne is currently awaiting transportation to the Iowa Medical and Classification Center at Oakdale to serve his ten year sentence. The Fremont County District Court case involving Thorne’s accomplice is still ongoing.  

This case was investigated by the Fremont County Sheriff’s Office in cooperation with the Cass and Montgomery County Sheriff’s Office. Fremont County Attorney Corey Becker prosecuted the case.

March 17, 2016: 

MCCOLLUM SENTENCED TO TEN YEARS IN PRISON FOR INTIMIDATION WITH A DANGEROUS WEAPON

SIDNEY, IOWA – Timothy Allen McCollum, age 40, Bartlett, Iowa, was sentenced on Monday, March 14 in Fremont County District Court to ten years in prison for Intimidation with a Dangerous Weapon, a Class C Felony. McCollum was arrested and prosecuted pursuant to a shooting that occurred in the early morning hours of Halloween 2015 in Bartlett, Iowa.  

Around 4 AM on October 31, 2015, the Fremont County Sheriff’s Office received an emergency report of shots fired in Bartlett, Iowa. The shots were investigated but their source could not be determined at the time. The next day, a 24 year old male reported to a local hospital with an apparent shotgun wound to the face. The male reported that he received the shotgun wound at Timothy McCollum’s house in Bartlett on Halloween after an argument between the two. The shotgun wound was not life threatening. The Fremont County Sheriff’s Office executed a search warrant at the McCollum property in Bartlett and found several guns, spent shells, and damage consistent with shotgun BB scatter. Other individuals on the property that night also reported seeing McCollum with a shotgun. McCollum was arrested and charged in connection with the shooting. McCollum is currently awaiting transportation to the Iowa Medical and Classification Center at Oakdale to serve his ten year sentence.

March 16, 2016: 

OMAHA WOMAN SENTENCED TO TEN YEARS IN PRISON FOR METHAMPHETAMINE DISTRIBUTION CONSPIRACY

SIDNEY, IOWA – Stacey Dawn Budenholzer, age 32, Omaha, Nebraska, was sentenced on Monday, March 14 in Fremont County District Court to ten years in prison for Conspiracy to Deliver Methamphetamine, a Class C Felony. Budenholzer was charged and convicted pursuant to a narcotics investigation in Shenandoah, Iowa. Budenholzer will not be eligible for parole until she has served at least one-third of her sentence under Iowa’s mandatory minimum sentencing law for methamphetamine distributors.  

On February 10, 2016, the Fremont County Sheriff’s Office Narcotics Unit, with the assistance of the Shenandoah Police Department, conducted a narcotics investigation in Shenandoah, Iowa.

While conducting this investigation, Budenholzer was found driving a car containing two other individuals. The car eventually parked in an apartment building parking lot and a male left the car to exchange the methamphetamine. The suspects were detained and the male was found in a hotel room with nearly 40 grams of methamphetamine on his person and $1,200 in cash. Budenholzer and the two accomplices were arrested and brought to the Fremont County Law Enforcement Center. While there, both Budenholzer and the male accomplice were found to have additional methamphetamine on them. Budenholzer is currently awaiting transportation to the Iowa Correctional Facility for Women at Mitchellville to serve her ten year sentence.  

This case was investigated by the Fremont County Sheriff’s Office in cooperation with the Shenandoah Police Department. Fremont County Attorney Corey Becker prosecuted the case.

Kiersten Caye Olney, age 19, Hamburg, Iowa, appeared with her attorney after having entered a plea of guilty to Gatherings Where Methamphetamine Unlawfully Used, a Class D Felony, and Conspiracy to Commit Burglary, an Aggravated Misdemeanor, on February 8, 2016. Judgement and sentenced were deferred for a period of two years. Olney was placed on formal probation for two years and required to complete inpatient substance abuse treatment as a condition of probation. Olney was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable.

March 7, 2016 

COWBOY PREACHER ROGER CRAIG KISSEL FOUND GUILTY OF SEXUAL ABUSE AND LASCIVIOUS ACTS WITH A CHILD

SIDNEY, IOWA – Roger Craig Kissel, age 68, Sidney, Iowa, was found guilty by a jury of his peers of Sexual Abuse in the Second Degree and two counts of Lascivious Acts with a Child. Sentencing is set for May 4, 2016 at 11:00 AM in the Fremont County Courthouse.  

On September 23, 2013, the Fremont County Sheriff’s Office received a report that Roger Craig Kissel had sexually abused a minor child that resided in his Sidney home sometime during the spring and summer of 2013. An investigation was conducted by then Sidney Chief of Police Austin Richardson with the cooperation of the Fremont County Sheriff’s Office and the Tabor Police. Following the investigation, criminal charges were filed in February of 2014. Roger Craig Kissel was brought to jury trial in the Fremont County District Court on March 1, 2016. Following a four-day jury trial, Roger Craig Kissel was found guilty of all counts after jury deliberations of approximately three hours. After the verdict was read, Roger Craig Kissel’s bond was revoked and he was taken into custody pending sentencing. Due to Sexual Abuse in the Second Degree being a forcible felony under Iowa Code, Roger Craig Kissel must receive a prison sentence of at least 25 years.

This case was investigated by the Sidney Police, the Fremont County Sheriff’s Office, and the Tabor Police. Fremont County Attorney Corey Becker and Assistant Attorney General Denise Timmins prosecuted the case.

Daniel Eugene Peters, age 26, Omaha, Nebraska, appeared with his attorney and entered a plea of guilty to Conspiracy to Deliver Methamphetamine, a Class C Felony. Peters was sentenced to 10 years in prison, all suspended, and placed on formal probation for two years. Peters was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable. 

Zachary James Ratliff, age 20, Hamburg, Iowa, appeared with his attorney and entered a plea of guilty to Theft in the Second Degree, a Class D Felony. Judgement and sentence were deferred for a period of two years. Ratliff was placed on formal probation for two years and assessed a civil penalty of $750. Ratliff was also ordered to pay all court costs, victim restitution, and court appointed attorney fees, if applicable.

Keith James Land, age 25, Clarinda, Iowa, appeared with his attorney and admitted to violating the terms and conditions of his probation. Land was found in willful contempt of court and sentenced to incarceration in the Fremont County Jail until January 13, 2016. Land is to remain on probation until his contempt sentence is finished. Land was also ordered to pay all court costs and court appointed attorney fees, if applicable.

On September 1, 2015, the Iowa District Court for Fremont County convened for the trial of State of Iowa vs. Thomas Aaron Ingram. At the conclusion of this two-day jury trial, Thomas Aaron Ingram, age 34, Farragut, Iowa, was found guilty of Sexual Abuse in the Third Degree, Lascivious Acts with a Child, and Assault by a jury of his peers. Bond was revoked and Ingram was taken into custody pending sentencing. Ingram is scheduled to be sentenced on Wednesday, October 28 at 1:30 pm in the Fremont County Courthouse.  

Kenneth Lee Inman, age 55, Hamburg, Iowa, appeared by his attorney and plead guilty to Assault on Persons Engaged in Certain Occupations, a Serious Misdemeanor. Inman was sentenced to 15 days in the Fremont County Jail and fined $315. Inman was also ordered to pay all court costs, surcharges, and court appointed attorney fees, if applicable.

Craig Edward Wallace, age 42, Shenandoah, Iowa, appeared with his attorney for sentencing after pleading guilty to Possession of Methamphetamine, Third or Subsequent Offense, While Being a Habitual Offender, a Class D Felony. Wallace was sentenced to five years in prison with a mandatory minimum of three years. Wallace was also ordered to pay all court costs and court appointed attorney fees, if applicable. 

Zachary Michael Anderson, age 30, Sidney, Iowa, appeared with his attorney and plead guilty to Failure to Comply with Sex Offender Registry, First Offense, an Aggravated Misdemeanor. Anderson was sentenced to a suspended sentence of two years and placed on formal probation for two years. Anderson was also ordered to pay all court costs and court appointed attorney fees, if applicable. 

Bret Phillip Samuelson, age 43, Randolph, Iowa, appeared with his attorney and plead guilty to Driving While Barred, an Aggravated Misdemeanor. Jessica Ann Hall, age 28, Omaha, Nebraska, appeared by her attorney and admitted to violating her probation pursuant to her October 6, 2014 plea of guilty to Theft in the Second Degree, a Class D Felony, and
Eluding a Law Enforcement Vehicle, a Class D Felony. Hall was sentenced to 192 days in jail, to be served concurrently with her charges in Douglas County, Nebraska. After Hall’s sentence is completed, she is
ordered to return to Iowa and reside at the Residential Correctional Facility until maximum benefits are reached.

Kevin Junior Booher, Jr., age 23, Hamburg, Iowa, appeared with his attorney and plead guilty to the charge of Assault on Persons Engaged in Certain Occupations, an Aggravated Misdemeanor. On May 4, 2015, 
Booher assaulted a Fremont County Sheriff’s Deputy in Hamburg. Booher was sentenced to two years in prison. Booher also admitted a probation violation. Booher was also ordered to pay all court costs, surcharges,
and court-appointed attorney fees.  

Hatem Bennour, age 43, Omaha, Nebraska, appeared with his attorney and plead guilty to Fraudulent Practice in the Third Degree, an Aggravated Misdemeanor. Bennour requested and received a deferred
judgment. Bennour was placed on informal probation for one year and fined $750. Bennour was also ordered to pay all court costs, surcharges, and supervision fees.  

Robert Alvin Cordell, age 55, New Market, Iowa, appeared with his attorney and plead guilty to Eluding a Law Enforcement Vehicle, an Aggravated Misdemeanor. Cordell was sentenced to 14 days in the Fremont County
Jail. Cordell was given credit for any time served and fined $625. Cordell was also ordered to pay all court costs, surcharges, and court-appointed attorney fees. 

Edward Allen Umbreit, age 57, Riverton, Iowa, appeared by his attorney and plead guilty to Assault, a Serious Misdemeanor. Umbreit was sentenced to 180 days in the Fremont County Jail, all but seven days suspended.
Umbreit was placed on informal probation for one year and fined $315. Umbreit was also ordered to pay all court costs, surcharges, supervision fees, and court-appointed attorney fees. 

Joshua Glenn Carpenter, age 38, Riverton, Iowa, appeared by his attorney and plead guilty to Operating While Intoxicated, First Offense, a Serious Misdemeanor. Sentencing is set for July 27, 2015 at 1:30 pm in the

After being found guilty of Operating While Intoxicated by a jury of his peers on June 2, Richard Charles Golden, age 21, Sidney, Iowa, appeared with his attorney for sentencing. Golden admitted this was his second offense. Golden
was sentenced to 180 days in the Fremont County Jail with all but 30 days suspended. Golden was also sentenced to one year of formal probation and a fine of $1,875.
Golden was also ordered to pay all fees and court costs associated with his trial.  

Trevor Scott Sparks, age 26, Raytown, Missouri, appeared with his attorney and plead guilty to the charge of Assault on Persons Engaged in Certain Occupations, a Class D Felony. On January 12, 2015, Sparks used his vehicle
to assault a peace officer. The defendant was sentenced to five years in prison. Sparks was also ordered to pay all court costs, surcharges, expenses, restitution, and court-appointed attorney fees.

 

Preston G. Struckmeyer, age 19, Papillion, Nebraska, appeared with his attorney and plead guilty to Possession of a Controlled Substance, Marijuana, a Serious Misdemeanor. Struckmeyer requested and was granted a deferred

On June 2, 2015, the Iowa District Court for Fremont County convened for the trial of State of Iowa vs. Richard Charles Golden. At the conclusion of this one day jury trial, Richard Charles Golden, age 20, Sidney, Iowa,
was found guilty of Operating While Intoxicated by a jury of his peers. As proven by the State at trial, Golden was operating while intoxicated southbound on Interstate 29 on August 23, 2014 at approximately the 13.5
mile marker. Golden is scheduled to be sentenced on Monday, June 22 at 1:30 pm in the Fremont County Courthouse.  

Denise Lynn Esquivel, age 41, Clarinda, Iowa, appeared by her attorney and plead guilty to the charge of Driving While License Denied or Revoked, a Serious Misdemeanor. The defendant was sentenced to sixty
days in jail, with all but two days suspended, and assessed a $1,000 fine. The defendant was also ordered to pay all fees, court costs, and court appointed attorney fees.

Donald James Ryan, age 38, Sidney, Iowa, appeared with his attorney and plead guilty to the charge of Possession of Methamphetamine with Intent to Deliver, a Class C Felony. Ryan admitted that on February
17, 2015, he possessed 18 grams of methamphetamine with the intent to deliver. Ryan was sentenced to ten years imprisonment with a mandatory minimum term. Ryan was also ordered to pay all court costs,
restitution, and court appointed attorney fees. 

Patrick Edward Hallas, age 37, Avoca, Iowa, appeared with his attorney and admitted to violating the terms of his probation for Operating While Intoxicated, Second Offense. Hallas was sentenced to 30 days in

Andrew Ryan Lemrick, age 24, Nebraska City, Nebraska, appeared by his attorney and plead guilty to Domestic Abuse Assault, an aggravated misdemeanor. Lemrick was placed on formal probation for one year and must complete the Iowa Domestic Abuse Program as a condition of probation. Samia Cali Xasan, age 24, Omaha, Nebraska, appeared with her attorney and plead guilty to the charge of Possession of a Controlled Substance (Marijuana). Xasan requested and was granted a deferred judgment. Xasan was placed on informal probation for one year and fined a civil penalty of $315. Xasan was ordered to pay all penalties, fees, court costs, and court appointed attorney fees

Keith James Land, age 24, Clarinda, Iowa, appeared with his attorney and admitted to violating the terms and conditions of his probation. Land was sentenced to reside at the Residential Correctional Facility in Council Bluffs until maximum benefits have been achieved. Land shall remain in custody pending bed space at the Facility. Land was also ordered to pay all costs and restitution of court appointed attorney fees. 

Jacob Dean Tacker, age 21, Shenandoah, Iowa, appeared by his attorney and plead guilty to the charge of Operating Motor Vehicle Without Owner’s Consent. Tacker was sentenced to 90 days in the county jail, all suspended, and placed on formal probation for one year. In addition, Tacker was sentenced to a fine of $625, plus all costs, fees, and restitution. The State of Iowa agreed to dismiss Count One, Theft in the Second Degree. 

Jennifer Elizabeth Younts, age 44, Tabor, Iowa, appeared with her attorney and plead guilty to the amended charge of Theft in the Fifth Degree. Younts was sentenced to a fine of $100, plus court costs, surcharges, and court appointed attorney fees.

The defendant served 10 days in jail prior to entering her plea. Between August 20, 2005 and February, 2014, she did forge documents involving Kevington Lane and Morse Enterprises.

Bradley Perry, 19, of Hamburg, pleaded guilty to Driving While Revoked and Possession of Drug Paraphernalia. The defendant also admitted to violating his probation. The defendant was ordered to serve 30 days in jail and was ordered to remain on probation. .On June 21, 2014, during a traffic stop he was found to be driving while his operator’s license was revoked and also in Possession of drug paraphernalia.

Todd Miller, 50, of Kansas City, Kansas pleaded guilty to OWI 1st Offense. He was sentenced to 10 days in jail and a $1,250 fine. On September 25, 2013, he operated a motor vehicle under the influence at the 300 block of 274th Ave.

Kevin Culley, 36, of Hamburg, pleaded guilty to Accessory After the Fact. He was sentenced to 2 years in prison, but the prison sentence was suspended and the defendant was placed on informal probation. The defendant served 10 days in jail. He had prior knowledge of the theft of firearms from a storage shed without reporting the crime.

Andrew Lemrick, 23, of Hamburg, pleaded guilty to Possession of Marijuana and was fined $315.00. On April 23, 2014, he was found in possession of marijuana.

Billy Price, 40, of Farragut, pleaded guilty to OWI 1st Offense. The defendant was sentenced to 60 days in jail with all but 2 days suspended for one year and was fined $1,250.00. The defendant successfully completed the Urban Dreams Second Chances course. On March 12, 2014, he operated a motor vehicle under the influence on Main Street in Sidney.

Nicolas Williams, 21, of Tabor, pleaded guilty to Trespass and Criminal Mischief in the 5th Degree. The defendant received a deferred judgment on both counts, and was placed on informal probation for 6 months. He was ordered to complete 40 hours of community service and pay restitution. Amber Parsons, 33 of Kingman Arizona pleaded guilty to Theft in the 3rd Degree. The defendant was sentenced to 70 days in jail. Between March 4 and March 10, 2014 she stole a checkbook and a debit card belonging to others, making unauthorized withdrawals totaling $1,900.

Fremont County Magistrate Court - 06/26/2014

Amber Sharp, 31, of Tabor pleaded guilty to failure to have a turtle helper license and illegal possession of fur-bearing animal out of season. She was fined $175 plus surcharge and court costs. She voluntarily agreed to suspend her turtle helper license for one year.

Nancy Covert, 59, of Tabor pleaded guilty to two counts of illegal possession of non-game species and was fined $200 plus surcharge and court costs.

Orrie Covert, 66, of Tabor was ordered to pay $850 in liquidated damages for illegally possessing out of season pelts.

Jesse Fregoso, 30, of Tarkio, MO, pleaded guilty to Criminal Mischief in the Fifth Degree. He was sentenced to seven days in jail and ordered to pay restitution.  On April 10, 2014, the defendant kicked the steering wheel and gear shift of the vehicle he was a passenger in, causing damage.

Amanda Driever, 44 of Sidney, pleaded guilty to OWI 1st Offense.  She received a deferred judgment and was placed on informal probation for one year. On May 9, 2014, she operated a motor vehicle under the influence on the 1800 block of Washington St in Hamburg. 

Walter Medina, 24 of Omaha, pleaded guilty to OWI 1st Offense and Providing False Identification Information to a Law Enforcement Officer.   The defendant was sentenced to 10 days in jail and was fined $1,250. On May 10, 2014, he operated a motor vehicle under the influence southbound I29 and provided a false name to a law enforcement officer.

Dakota Lee Standley, 22 of Moberly, MO, pleaded guilty to Theft in the Fifth Degree and admitted to violating his probation. He was sentenced to 30 days in jail. On January 13, 2014 he pled guilty and was placed on probation for Possession of a Controlled Substance.  

Donovan Hankins, 33, of Tabor, pleaded guilty to Simple Domestic Assault. He was sentenced to 30 days in jail with 28 days suspended for one year. The Defendant was placed on informal probation for one year. On May 13, 2014 he assaulted his girlfriend.

Kelly Roof, 41, of Tabor, pleaded guilty to Theft in the First Degree.  The defendant received a deferred judgment and was placed on supervised probation for 2 years. Between February 28, 2014 and March 13, 2014 Roof removed approximately 2,230 bushels of soybeans from the on-farm storage facilities of his employer without the permission of his employer. Roof then sold the soybeans and used the profits to purchase a Polaris ATV. The Fremont County Attorney would like to thank and acknowledge Deputy Andrew Wake and the Fremont County Sheriff’s Department for their excellent investigation of this matter 

Daniel Gubser, 36, of Hamburg, pleaded guilty to Burglary in the Third Degree and Possession of Methamphetamine.  The defendant was sentenced to 5 years in prison, but the sentence was suspended and he was placed on supervised probation for 2 years.  The defendant was sentenced to 4 days in jail on his possession of methamphetamine conviction.  On or about Feb 20, 2014, Gubser removed tools from a farm property. Gubser then admitted he was in possession of methamphetamine when questioned by law enforcement.

Robert Greenwood, 39, of Council Bluffs, IA, pleaded guilty to Forgery and was sentenced to 57 days in jail. The defendant was convicted of forging work release papers. 

Jared Meyer, 25, of Council Bluffs, IA pleaded guilty to OWI 1st Offense. The defendant was sentenced to 30 days in jail with 26 days suspended for one year. The defendant was placed on informal probation and ordered to pay $1,250 plus restitution.
On March 16, 2014 the defendant was intoxicated and parked his vehicle in the traveled lanes of I-29, causing an accident.

Jeffrey Fuller, 25, of Anderson, IA, pleaded guilty to Trespass Causing Damage and was sentenced to 30 days in jail with 22 suspended for one year. The defendant was placed on informal probation and ordered to pay restitution. On April 27, 2014
he drove his vehicle into a planted field, causing damage. 

Joseph Hastie, 37, of Glenwood, pleaded guilty to Eluding a Police Officer and was sentenced to 27 days in jail. On March 27, 2014, the defendant led law enforcement on a chase, traveling over 100 mph outside of Tabor, IA. 

Corey Graves, 22, of Omaha, NE, pleaded guilty to Possession of Marijuana and was fined $315. On February 25, 2014, he was found to be in possession of marijuana during a traffic stop.

Christopher Richter, 23, of Sidney, admitted to violating his probation and was found in contempt of court. The defendant was sentenced to 150 days in jail. On January 13, 2014, the defendant was placed on probation after being convicted of two burglaries.

Craig D. Ellis, 34, of Council Bluffs, IA, was sentenced to 10 years in Prison in Fremont County District Court on April 21. Prior to sentencing, Ellis pleaded guilty to Possession of Controlled Substance (Marijuana) with the Intent to Deliver and Failure to Affix a Drug Tax Stamp.  He received a 5 year prison sentence on each conviction and the convictions were run consecutively for a total of 10 years. On February 14, 2014, he was found to be in possession of a controlled substance during a traffic stop. 

Fremont County Attorney James Burger said the conviction is due to the hard work of local law enforcement and the helpful tips given by area residents.  

“When people call in with tips and information it makes the investigation of cases and the eventual prosecution so much easier,” Burger said.  

Jacob John Peters, 27, of Hamburg, pleaded guilty to Assault Causing Injury. The Defendant received a deferred judgment and was ordered to pay restitution. Peters also spent two days in jail. On October 20, 2013, he assaulted another causing serious injury. 

Jeffery A. McClarnon, 27, of Clarinda, pleaded guilty to Possession of a Controlled Substance (Methamphetamine) and received a deferred judgment. On January 19, 2014, a report of a suspicious vehicle at Nishnabotna High School led to the arrest of McClarnon. 

Jeremy K. Foreman, 29, of Nebraska City, pleaded guilty to OWI 1st Offense and received a deferred judgment. The date of the offense was October 12, 2013. 

Francisco J. Avila, 40, of Buckles TX, pleaded guilty to OWI 3rd Offense and was sentenced to 30 days in jail. On April 22, 2014, an employee at a local truck stop called to report the Defendant was in the truck stop attempting to purchase alcohol and noticeably intoxicated. When he left the store, she was able to get vehicle information and saw which direction he drove, leading to his arrest.

James Miller, 27, of Auburn, NE pleaded guilty to Failure to Affix a Drug Tax Stamp and Driving While Barred.  On the Drug Tax Stamp conviction, the defendant was sentenced to 5 years in prison and fined $750.  On the Driving While Barred conviction, the defendant was sentenced to 2 years in prison and fined $625.  Both the prison sentences and fines were suspended, and the defendant was placed on supervised probation for 2 years.  On October 3, 2013, during a traffic stop, the defendant was found with over 5 grams of methamphetamine. 

Charlene Chaney, 28, of Tabor, plead guilty to Child Endangerment and Theft in the 4th Degree.  She received a deferred judgment on both charges and was placed on informal probation for one year. On or about July 14, 2013, she took possession of items stolen from Farm Services.  

Aaron Latus, 33, of Atlantic, was found in contempt of court for violating the terms of his probation.  The defendant was sentenced to 180 days in jail.  On March 19, 2012, the defendant plead guilty to Serious Injury by Vehicle and was placed on probation.   

Derrian Bredberg, 21, of Tabor pleaded guilty to Possession of Drug Paraphernalia.  He received a deferred judgment and was assessed a civil penalty of $65. On October 6, 2013, he was found to be in possession of drug paraphernalia during a traffic stop. 

Derrick Traub, 34, of Brownville, NE pleaded guilty to 2 counts of Possession of Marijuana.  The defendant was sentenced to 30 days in jail on each count.  The defendant is currently serving a prison sentence in Nebraska, and his 30 day jail sentence is to be served concurrently with his prison sentence. 

Kip Kalkas, 34, of Shenandoah, pleaded guilty to Reckless Use of Fire.  The defendant received a deferred judgment and was assessed a civil penalty of $315.  On January 27, 2014, the defendant burned copper wire on property belonging to Jerry Holt. 

Christopher Rasmussen, 44, of Sidney pleaded guilty to OWI First Offense.  He was sentenced to 30 days in jail with 28 days suspended and he was placed on informal probation for one year.  He was also fined $1,250.00 and ordered to pay restitution to the victim of this offense. On February 7, 2014, while under the influence of alcohol, he drove his pickup into a residence at the intersection of Maple and North Streets in Sidney. 

Danny Miller, 63, of Sidney pleaded guilty to OWI First Offense.  He was sentenced to 60 days in jail with 53 days suspended and he was placed on informal probation for one year.  He was also fined $1,250.00. On September 21, 2013, he operated a motor vehicle under the influence of alcohol on Illinois St in Sidney.  

Melvin Jurey, Jr., 36, of Sidney pleaded guilty to Assault Causing Injury and was placed on supervised probation for one year. On February 15, 2014, he assaulted his wife and his sister.

Mesenda Swan, 28, of Hamburg, pleaded guilty to Theft in the 5th Degree.  She was sentenced to 30 days in jail with all 30 days suspended.  She was ordered to pay restitution in the amount of $300.  On August 3, 2014 the defendant used the debit card of Harold Swan, Sr. to withdraw $300 without his permission. 

Charges against Harold Swan Jr, 39, of Hamburg, were dismissed pursuant to Mesenda Swan’s plea to Theft in the 5th Degree. 

Joyce Cox, 50, of York, NE, pleaded guilty to OWI First Offense.  She was sentenced to 30 days in jail with 28 days suspended for one year, and was placed on informal probation.  She was fined $1,250.00.  On December 30, 2013, she operated a motor vehicle while under the influence of alcohol near the 1 mile marker of I-29.

Andrew James Kluver, 22, of Randolph was sentenced to 20 years in prison for the sexual abuse of two minor children. Prior to the sentencing
Kluver admitted to sexually abusing the boys on separate occasions when they were approximately 2-years-old. The abuse occurred between
2009 and 2013. 

On March 17, 2014, Kluver pled guilty to one count of Sexual Abuse in the 3rd Degree, a Class C Felony and one count of Lascivious Acts
with a Child, also a class C Felony. Both charges carry 10 year sentences, which will run consecutively.  He also received a lifetime special
sentence, which will essentially act as a lifetime parole and begin when he is released from prison. He will also be required to register
as a sex offender for the rest of his life. No Contact Orders between Kluver and the victims will continue for 5 years and may be extended
at the request of the victims. 

District Court Judge Kathleen Kilnoski stated during sentencing she felt the length of the prison sentence was appropriate to protect the
community and to give Kluver the opportunity to rehabilitate.  

“I would like to thank Project Harmony, the family of the victims and local law enforcement for all the hours they devoted to this case,” County
Attorney James Burger said. “The successful prosecution of this case has been a group effort.”

Christopher Richter, 23, of Sidney pleaded guilty to OWI 1st offense.  He was sentenced to serve 2 days in jail and was fined $1,250. On January 2, 2014, he operated a motor vehicle near the intersection of Highway 2 and airport road under the influence of an alcoholic beverage or other drug combination. 

Jimmie George Parker, 69, of Tabor, pleaded guilty to three counts of Harassment in the Third Degree. No contact orders with the victims will remain in place for five years and may be extended if requested. On August 6, 2013, he harassed female minors at the Casey’s in Tabor.

Kelli Gould,
51,of Shenandoah, pleaded guilty to Failure to Affix a Drug Tax Stamp and Possession of Methamphetamine.  On the Drug Tax Stamp conviction, the defendant was sentenced to 5 years in prison.  The prison sentence was suspended and she was placed on supervised probation for 2 years.  On the Possession of Methamphetamine conviction, the defendant was ordered to serve 30 days in jail.  On February 14, 2014, during a traffic stop, the defendant was found to be in possession of over 5 grams of methamphetamine.

Aaron Major, 35, of Shenandoah, IA, plead guilty to OWI First Offense. He was sentenced to 4 days in jail and was fined $1,250. On November 27, 2013, operated a vehicle while intoxicated, causing an accident

Colton Sederburg, 20, of Shenandoah, admitted to violating the terms of his probation. His deferred judgment was revoked and he was sentenced to a prison term not to exceed 5 years for the Burglary in the 3rd Degree conviction. The prison sentence was suspended. The defendant was also found in contempt of court and was sentenced to 90 days in jail. On May 28, 2013, he plead guilty to Burglary in the 3rd Degree. He received a deferred judgment on those charges and was placed on supervised probation.

Charges against Ambriea Chandler, 21, of Sidney were dismissed pursuant to a deferred prosecution agreement.

Bradley Wright, 22, of Percival, plead guilty to Disarming a Peace Officer of a Dangerous Weapon, Assault on a Peace Officer Causing Bodily Injury, Insufficient Number of Headlamps, and Open Container. The Defendant was granted a deferred judgment on the Disarming charge, but was convicted of Assault on a Peace Officer Causing Bodily Injury. The Defendant was placed on supervised probation for two years and served 20 days in jail. The Defendant has a potential 7-year prison sentence to serve if his probation is revoked. The Defendant was forever barred from obtaining a Carrying a Concealed Weapon Permit. On October 30, 2013, the Defendant assaulted a Fremont County Deputy after eluding a traffic stop.

Pedro Novelo, 42, of Kansas City, KS, plead guilty to OWI. He was sentenced to two days in jail and a fine of $1,250. On September 26, 2013, the Defendant was driving while intoxicated, resulting in a one-vehicle accident at the intersection of Main Street and Highway 275 in Sidney.

William Howard, 27, of Nebraska City, pled guilty to OWI and received a deferred judgment for a period of one year. On December 15, 2013, the Defendant was driving while intoxicated near the 5 mile marker of northbound I-29.

Christopher Bowers, 32, of Shenandoah, plead guilty to Reckless Use of Fire or Explosives. He was sentenced to 19 days in jail. On January 27, 2014 the Defendant started a copper wire on fire to burn the insulation off insulation causing a field to catch fire.

Charges against Frederick Miles Sr, 60, of Riverton were dismissed due to insufficient evidence.

Michael McFarland, 39, of Grain Valley, MO, plead guilty to three counts of Door-to-Door Sales Fraud. Judgment was deferred for a period of one year conditioned upon the defendant having no arrests and paying restitution to the victim. On or about July 30, 2013, the Defendant sold asphalt paving services door-to-door at an inflated price and without providing proper documentation.

Virgil Boomgaarn, 19, of Hamburg, plead guilty to two counts of Harassment 3rd Degree. He was sentenced to 30 days in the county jail on each count. The sentence was suspended for six months and the Defendant is to have no contact with the victims. On or about September 2, 2013 the Defendant sent threatening text messages to multiple individuals and further harassed them while trick-or-treating on October 31, 2013.

Isaac Hayes, 27, of Hamburg, plead guilty to Assault Causing Injury and admitted to violating his probation. Charges of Simple Domestic Assault were dismissed. He was sentenced to 90 days in jail for Probation Violation and 30 days in jail for Assault Causing Injury.

The defendant was sentenced to 120 days in jail on the Harassment in the First Degree charge and 30 days on each Harassment in the Third Degree charge. On September 25, 2013, the defendant threatened to shoot his grandparents while attempting to load a gun.

Sherika Shelly, 24, of Omaha, plead guilty to Possession of Drug Paraphernalia and was fined $65. On February 12, 2014 she was found to be in possession of drug paraphernalia during a traffic stop on I29. Possession of Marijuana charges are pending in district court.

Michael Glenn, 23, of Farragut, admitted to violating the terms of his probation. The defendants deferred judgments were revoked and the defendant was sentenced to a prison term not to exceed 5 years for the Burglary in the 3rd Degree conviction and 60 days in jail for the Theft in the 4th Degree conviction. The prison sentence was suspended, and the defendant was ordered to continue his probation; however, the defendant was placed at the Residential Correctional Facility until maximum benefits are obtained. On November 4, 2013 he plead guilty to Burglary in the 3rd Degree and Theft in the Fourth Degree. He received a deferred judgment on those charges and was placed on supervised probation.

Heath McClarnon, 39, of Clarinda, admitted to violating terms of his probation. He was found to be in contempt and sentenced to 60 days in the county jail. He was ordered to continue probation. On July 23, 2013, he plead guilty to Possession of a Controlled Substance with Intent to Deliver, Methamphetamine. His sentence was suspended and he was placed on supervised probation.

Dominique Schlup, 19, of Hastings, IA, plead guilty to Theft in the 2nd Degree, and Eluding, both Class D felonies, and Driving While Revoked, a serious misdemeanor. The defendant was sentenced to 10 years in prison. On September 20, 2013, the defendant stole a vehicle and eluded Fremont County authorities at a high rate of speed through Fremont County. 

Andrew Hughes, 24, of Randolph, IA, plead guilty to Possession of Methamphetamine, a serious misdemeanor, and admitted to violating his supervised probation. The defendant was sentenced to 50 days in jail for the Possession of Methamphetamine, and two years in prison for violating his probation. On November 27, 2013, the defendant was found in possession of methamphetamine in violation of his probation. 

Jarrod Crawley, 30, of Shenandoah, IA, plead guilty to Burglary in the 3rd Degree, a Class D felony. The defendant received a deferred judgment and was placed on supervised probation. The defendant committed the burglary in October, 2013. 

Michael Frakes, 25, of Nebraska City, NE plead guilty to Possession of Methamphetamine, a serious misdemeanor. The defendant received 180 days in jail with all but 44 days of the sentence suspended for one year. The defendant was placed on informal probation. The defendant spent 44 days in jail.  On December 8, 2013, the defendant was found in possession of methamphetamine at Wendy’s. 

Matthew Campbell, 29, of Riverton, IA, plead guilty to OWI 2nd Offense and Driving while Barred, both aggravated misdemeanors, and Harassment in the 3rd Degree, a simple misdemeanor.  The defendant was sentenced to 180 days in jail with all but 30 of the days suspended for one year. The defendant will serve 30 days in jail. The defendant was placed on informal probation. On October 5, 2013, the defendant operated his vehicle while he was under the influence of alcohol, and while he was barred from driving. 

Bradley Perry, 18, of Hamburg, IA, plead guilty to Operating Without Owner’s Consent, an aggravated misdemeanor, and OWI 1st Offense, a serious misdemeanor. The defendant received a deferred judgment on both charges and was placed on informal probation. On August 14, 2013, the defendant operated a motor vehicle that he did not have permission to drive while under the influence of a controlled substance. 

Cody Gray, 21, of Tabor, IA, plead guilty to Possession of Marijuana, a serious misdemeanor. The defendant received a deferred judgment. On October 5, 2013 the defendant was found in possession of marijuana. 

Richard Golden, 18, of Sidney, IA, plead guilty to Possession of Marijuana, a serious misdemeanor. The defendant was sentenced to 30 days in jail with all but 10 days suspended.  The defendant served 10 days in jail. The defendant was placed on informal probation. Land, Keith, 23, of Clarinda, IA, plead guilty to Burglary in the 3rd Degree, a Class D Felony. He was sentenced to five years in prison. The sentence was suspended and he was placed on supervised probation. Fingerprints recovered from a home that was broken into on April 29, 2013 were identified as Land’s.

Standley, Dakota Lee, 22, of Hamburg, IA, pled guilty to Delivery of Oxycodone, a Class C felony. The defendant received a deferred judgment and was placed on supervised probation. On December 8, 2013, Standley sold 6 oxycodone pills to an informant.

Smith, Phillip, 42, of Council Bluffs, IA, pled guilty to Criminal Mischief in the 3rd Degree, an Aggravated Misdemeanor, and Theft 4th Degree, a Serious Misdemeanor. He was sentenced to 90 days in jail. On July 18, 2013, he took copper wire from an irrigation pivot.

Richter, Christopher, 23, of Sidney, IA, pled guilty to two counts of Burglary in the 3rd Degree, both Class D felonies. He was sentenced to five years in prison, but the sentence was suspended and he was placed on supervised probation. He committed several burglaries on December 28, 2013.

Winn, David, 24, of Carter Lake, IA, pled guilty to Possession of Marijuana. He received a deferred judgment. The defendant was found in possession of marijuana on October 26, 2013.

Lukas, John B, 34, of St. Joseph, MO, plead guilty to OWI and was sentenced to 60 days in jail with all but 5 days suspended. He was placed on unsupervised probation for one year. The offense occurred on October 19, 2013 in the 2000 block of Highway 2. 

Marasco, Jason R., 31, of Pacific Junction, IA, pled guilty to Burglary in the Third Degree, a Class D Felony. He also plead guilty to six counts of Burglary in the Third Degree of an Unoccupied Motor Vehicle, an aggravated misdemeanor. He was sentenced to seven years in prison. The sentence was suspended and the defendant was placed on supervised probation for two years. He served 27 days in jail prior to entering his plea. On October 2, 2013, he broke into Redline Oil in Thurman, as well as into multiple vehicles located at Redline Oil. 

Osborn, Doyle, 35, of Omaha, NE, plead guilty to Possession of a Controlled Substance with Intent to Deliver 5 grams or less of methamphetamine, a Class C Felony. The Defendant was sentenced to a term not to exceed 10 years in prison. The sentence was suspended and the Defendant was placed on supervised probation for three years. He spent 91 days in jail prior to entering his plea. On October 3, 2013 at the 2400 block of Highway 275, he was found to be in possession of 12 grams of methamphetamine and was transporting it to Hamburg, Iowa. 

Wyland, Christopher, 26, of Hamburg, plead guilty to Domestic Abuse Assault while using or Displaying a Dangerous Weapon, an Aggravated Misdemeanor. He was sentenced to a term not to exceed two years in prison. The sentence was suspended and he was placed on supervised probation for one year.  He spent 26 days in jail prior to entering his plea. On December 10, 2013, he threatened his girlfriend with a knife.

Booher, Ronda, 39, of Hamburg, IA, plead guilty to possession of marijuana and was fined $315. The offense occurred on July 17, 2013 at the Nishnabotna River boat ramp in Hamburg.

Johnson, Raymond, 39, of Seneca, MO, pled guilty to Possession of Marijuana and Driving While Revoked. He was sentenced to 60 days in jail. The offense occurred on October 12, 2013 in the 2600 block of 290th Ave.

Miller, David, 43, of Hamburg, IA, plead guilty to Assault While Using or Displaying a Dangerous Weapon. He was sentenced to 180 days in jail with all but 44 days suspended and placed on supervised probation for one year. On November 1, 2013, he pointed a .22 caliber semi-automatic pistol at another.

Wilson, Joseph, 28, of Rockport, MO, was sentenced to five years in prison after his probation was revoked. On April 15, 2013, he was convicted of Railroad Vandalism and placed on Supervised Probation. 

Davis, Jeffrey, 41, of Oregon, MO, plead guilty to OWI 3rd Offense. He was sentenced to a suspended 5 year prison sentence and placed on supervised probation for two years. The defendant was ordered to serve 30 days in jail and pay a fine of $3,125.00. On November 8, 2013, he was driving while intoxicated at 2101 249th St, Percival. 

O’Dell, Alexandria, 22, of Hamburg, IA, plead guilty to Possession of Marijuana and was fined $315.00. On September 27, 2013, she was in possession of Marijuana. 

Svajgl, Donald R. Jr., 28, of Nebraska City, NE, plead guilty to OWI. He was sentenced to 30 days in jail with 28 days suspended for 12 months and fined $1,250.00. On September 14, 2013, he was driving while intoxicated at Washington and E Streets, Hamburg. 

Calachij- Guitierrez, Luis Humberto, 21, of Schuyler, NE, plead guilty to OWI and received a deferred judgment. On September 7, 2013, he was driving while intoxicated at 310th St and Railroad Ave, Hamburg.

Stogdill, Jennifer, 38, of Imogene, Iowa, plead guilty to Compounding a Felony. She was sentenced to 365 days in jail with all 365 days suspended for 12 months. She was placed on unsupervised probation.  Between December 2009 and November, 2010 she had knowledge Tony Stogdill was committing a felony in the State of Iowa and received consideration, including continued financial support and continued familial support for a promise to conceal or for a promise not to prosecute, aid or give evidence to the prosecution concerning Tony Stogdill’s crime.

Smith, Lindsey, 23, of Plattsmouth, NE, plead guilty to Theft in the 2nd Degree. She received a Deferred Judgment and was placed on supervised probation for two years. She was ordered to pay restitution. On November 8, 2013, she took possession of a 2012 Jeep Liberty belonging to another with the intention to deprive the owner thereof.

Charges against Kitchens, Daniel, 55, of Thurman, IA, were dismissed pursuant to a deferred prosecution agreement.

Poe, Eric Franklin, 25, of Atlantic, IA, plead guilty to Stalking and Harassment in the 3rd Degree. He was sentenced to 30 days in jail and two years of Supervised Probation. Between June 2012, and April 2013, Franklin sent numerous threatening text messages to a minor, stalking and harassing her.

Glenn, Michael, 23, of Farragut, IA, plead guilty to Burglary in the 3rd Degree, Theft in the 4th Degree and Possession of Drug Paraphernalia. The defendant received a deferred judgment and was placed on supervised probation for 2 years. He was ordered to complete 100 hrs of community service. On or about October 13, 2012, he burglarized several properties. 

Schlup, Dominique, 18, of Hastings, IA, plead guilty to Theft in the 2nd Degree, Felony eluding and Driving While Revoked. Judgment was deferred and he was placed in drug court for two years. On September 20, 2013, he stole a pickup truck from a residence in Tabor, Iowa and lead law enforcement on a high speed chase, ending in Mills County, Iowa.  

Morse, Caleb, 22, of Council Bluffs, IA, plead guilty to OWI 2nd Offense. He was sentenced to 30 days in jail with all be 7 days suspended for one year. He was fined $1,875 plus surcharge and costs. On August 20, 2013, the vehicle he was operating was involved in a roll-over accident in the 1000 block of 200th St, just west of Interstate 29. His blood alcohol content registered at .151 when tested. 

Jacobsen, Scott, 26, of Council Bluffs, IA, plead guilty to Providing False Information and was sentenced to 30 days in jail.  On October 4, 2013 he gave a false identity to law enforcement investigating a stolen vehicle. 

Robinson, Marissa, 21, of Hamburg, IA, plead guilty to OWI 1st Offense. She was sentenced to two days in jail and fined $1,250 plus surcharge and costs. On September 22, 2012, the vehicle she was driving was involved roll-over accident near the intersection of V and Washington Streets in Hamburg.  Her blood alcohol content registered at .152 when tested.

Carnes, Jeremy Scott, 32, of Pacific Junction, IA, plead guilty to Harassment in the 3rd Degree. He was sentenced to 30 days in the Fremont County Jail, receiving credit for time served. On September 7, 2013, he threatened to commit a forcible felony against a family camping at Crystal Lake.

Jordon, Christopher, 25, of Sidney, IA, plead guilty Assault. He was sentenced to time previously served. On September 22, 2013, he punched another in the face multiple times, causing injury.

Rakes, Christopher, 34, of Riverton, IA, plead guilty Theft in the 1st Degree. He was sentenced to 10 years in prison. The sentence was suspended and he was placed on Probation for a period of two years. On October 12, 2012, he removed 12 electric bin fan motors and fan blades having a total value exceeding $10,000 from a Fremont County farm.

Hurt, Gavin F., 30, of Sidney, IA, plead guilty to Possession of Marijuana and Gatherings where Controlled Substances were Unlawfully Used. He was sentenced to 365 days in jail with all but 30 days suspended for one year. On September 12, 2013 he was found in possession of 22 grams of marijuana when rescue personnel were called to his home responding to possible drug overdose. 

Vazques, Victoria Yvonne, 36, of Brownsburg, IN, plead guilty to Possession of Methamphetamine and Possession of Marijuana. Judgment in the case was deferred on each plea for one year. She will be transported to Indiana where she has pending drug charges. On August 25, 2013, an employee of a Percival, Iowa, motel contacted law enforcement to report hotel guests left syringes and drugs in their room at checkout. Law enforcement used information from the hotel to locate the suspects, Vazques and Aslan Petty at a nearby truck stop in possession of 12 grams of methamphetamine, 82 grams of marijuana as well as a variety of other drugs and paraphernalia.

He was sentenced to 5 years in prison. On August 25, 2013, an employee of a Percival, Iowa, motel contacted law enforcement to report hotel guests left syringes and drugs in their room at checkout. Law enforcement used information from the hotel to locate the suspects, Petty and Victoria Vazques at a nearby truck stop in possession of 12 grams of methamphetamine, 82 grams of marijuana as well as a variety of other drugs and paraphernalia.

Rutherford, Lisa Marie, 43, of Shenandoah, IA, plead guilty to Criminal Mischief in the 5th Degree. She was sentenced to 30 days in jail with the sentence suspended for one year without supervision. On July 27, 2013 she broke the windows out of a small camper and burned lawn chairs belonging to another.

Moore, Rodney Dewayne, 50, of Hamburg, IA, plead guilty to Possession of Methamphetamine, 2nd Offense, an Aggravated Misdemeanor. The date of the offense was June 4, 2013. The methamphetamine was discovered during a probation search of his home. He was sentenced to 45 days in jail and issued a $625 fine. 

Nading, Miranda Rose, 27, of LaVista, NE, plead guilty to Possession of Marijuana, a Serious Misdemeanor. The date of the offense was August 2, 2013. She was sentenced to 30 days in jail, with 28 days suspended and issued a $315 fine. She was placed on unsupervised probation for a period of one year.  

Dumler, Quentin Rex, 19, of Shenandoah, IA was sentenced to a three-year deferred judgment and placed on supervised probation for a period of three years. He was found guilty of the charges of for Burglary in the 3rd Degree, Criminal Mischief 3rd, Criminal Mischief 3rd and Theft 4th Degree on May 10, 2013, after a bench trial. Dumler broke into Skateland Roller Rink in Shenandoah, on November 3, 2012, stealing money and damaging property.

Propp, David Wayne, 49, of Sidney, IA, plead guilty and was sentenced for Operating While Intoxicated, First Offense. The date of the offense was January 11, 2013.
He was sentenced to 30 days in jail with 26 days suspended and issued a $1,250 fine. He was further ordered to complete a substance abuse evaluation and complete a drinking
driver’s course.

Parker, Jimmie Dean, 60, of Shenandoah, IA, plead guilty and was sentenced for Assault with a Deadly Weapon. The date of the offense was July 7, 2013. He received a deferred judgment and was placed on supervised probation for one year and ordered to pay restitution. In addition, he was ordered to surrender his concealed weapon permit as well as surrender any interest in the seized weapon held by the Fremont County Sheriff.
